General

1.1 These general terms and conditions (the Conditions) apply to any use of the website www.uniqbridles.com (the website) and all subdomains. The terms and conditions also apply to all services we offer. If you have a question about these terms or would like to contact us for any other reason, send an email to support@uniq-bridles.onyxer.agency.

1.2 By placing an order you indicate that you agree with the terms of delivery and payment. UNIQBridles.com reserves the right to change its delivery and/or payment conditions after the expiry of the term.

1.3Unless otherwise agreed in writing, the general or specific terms and conditions or stipulations of third parties are not recognized by uniqbridles.com.

1.4 Uniqbridles.com guarantees that the delivered product meets the agreement and meets the specifications stated in the offer.

Delivery

2.1 Delivery takes place while stocks last.

2.2 Under the rules of distance selling, uniqbridles.com will execute orders within 30 days. If this is not possible (because the ordered item is out of stock or no longer available), or there is a delay for other reasons, or an order cannot or only partially be executed, the consumer will receive payment within 1 month after placing the order. the order and in that case he has the right to cancel the order without costs and notice of default.

2.3 The delivery obligation of uniqbridles.com will be fulfilled, with the exception of, subject to proof to the contrary, once the goods delivered by uniqbridles.com have been offered to the customer. In the case of home delivery, the carrier’s report, including the refusal of acceptance, serves as full proof of the offer for delivery.

2.4 All terms stated on the website are indicative. No rights can therefore be derived from the stated periods.

Prices

3.1 Prices will not be increased within the term of the offer, unless legal measures make this necessary or if the manufacturer implements interim price increases.

3.2 All prices on the site are subject to printing and typesetting errors. No liability is accepted for the consequences of printing and typesetting errors.

3.3 All prices on the site are in euros and include 21% VAT.

Trial period/right of withdrawal

4.1 In the case of a consumer purchase, in accordance with the Distance Selling Act (Article 7:5 of the Dutch Civil Code), the customer has the right to return (part of) the delivered goods within a period of 14 days without giving any reason. valid on all standard items and with the exception of our personalized printed items and the Swarovski collection, which are handmade to order and are therefore non-returnable.

This period starts at the moment that the ordered goods have been delivered. If the customer has not returned the delivered goods to uniqbridles.com after this period, the purchase is a fact. The customer is obliged, before proceeding to return, to report this in writing (by email) to uniqbridles.com within the period of 14 days after delivery. The customer must prove that the delivered goods have been returned on time, for example by means of proof of postal delivery. Return of the goods must be in the original packaging (including accessories and accompanying documentation) and in new condition. If the goods have been used, encumbered or damaged in any way at the customer, the right to dissolution within the meaning of this paragraph lapses. With due observance of the provisions of the previous sentence, uniqbridles.com will ensure that the full purchase price is refunded to the customer within 30 days after proper receipt of the return shipment. The return of the delivered goods is entirely at the expense and risk of the customer.

Our browbands and decorations on horse items are custom made by hand, especially for you. The Right of Withdrawal hereby expires. Unless the consumer can clearly demonstrate that the custom-made product does not comply with the agreement concluded between the consumer and the entrepreneur.

4.2 The right to dissolution, as described in the previous paragraph, only relates to the delivered goods.

4.3 The right of withdrawal does not apply to:

  • goods that are manufactured according to the consumer’s specifications, for example custom work, or that have a clear personal character. (Think, for example, of the browbands that are made to your own design)
  • goods that cannot be returned due to their nature, for example due to hygiene.

Data Management

5.1 If you place an order with uniqbridles.com, your details will be included in the customer base of uniqbridles.com. Uniqbridles.com complies with the Law Personal registrations and will not provide your data to third parties. See our Privacy Policy.

5.2 Uniqbridles.com respects the privacy of the users of the internet site and ensures that your personal data is treated confidentially.

5.3 Uniqbridles.com uses a mailing list in some cases. Each mailing contains instructions to remove yourself from this list.

Warranty

6.1 Uniqbridles.com guarantees that the products it supplies meet the requirements of usability, reliability and lifespan as reasonably intended by the parties to the agreement, and therefore guarantees the manufacturer’s warranty of the product delivered to you.

6.2 However, Uniqbridles.com is never responsible for the ultimate suitability of the items for each individual application by the customer, nor for any advice regarding the use or application of the items.

6.3 The customer is obliged to immediately check the delivered goods upon receipt. If it appears that the delivered goods are wrong, defective or incomplete, the customer (before proceeding to return them to uniqbridles.com) must immediately report these defects in writing (via email) to uniqbridles.com. Any defects or incorrectly delivered products must and can be reported to uniqbridles.com in writing no later than 14 days after delivery. The goods must be returned in the original packaging (including accessories and associated documentation) and in new condition. Putting into use after detection of defect, damage caused after detection of defect, encumbrance and/or resale after detection of defect, this right to complain and return expires completely.

6.4 If the complaints of the customer are found to be well-founded by uniqbridles.com, uniqbridles.com will, at its option, either replace the delivered goods free of charge or make a written (via email) arrangement with the customer about compensation, on the understanding that the liability of uniqbridles.com and therefore the amount of compensation is always limited to a maximum of the invoice amount of the goods in question, or (at the option of uniqbridles.com) to the maximum amount covered by the liability insurance of uniqbridles.com in the relevant case. Any liability of uniqbridles.com for any other form of damage is excluded, including additional compensation in any form whatsoever, compensation for indirect or consequential damage or damage due to lost profit.

6.5 The guarantee does not apply if: A) and as long as the customer is in default towards uniqbridles.com; B) the customer has repaired and/or processed the delivered goods himself or has had them repaired and/or processed by third parties; C) the delivered goods have been exposed to abnormal conditions or are otherwise handled carelessly or contrary to the instructions of uniqbridles.com; D) the defect is wholly or partly the result of regulations that the government has set or will set with regard to the nature or quality of the materials used.

Offers

7.1 Offers are without obligation, unless stated otherwise in the offer.

7.2 Upon acceptance of a non-binding offer by the buyer, uniqbridles.com reserves the right to revoke or deviate from the offer within a period of 3 working days after receipt of that acceptance.

7.3 Verbal promises only bind uniqbridles.com after they have been confirmed explicitly and in writing (by email).

7.4 Offers from uniqbridles.com do not automatically apply to repeat orders.

7.5 Uniqbridles.com cannot be held to its offer if the customer should have understood that the offer, or a part thereof, contained an obvious mistake or error.

7.6 Additions, changes and/or further agreements are only valid if agreed in writing (by email).

Agreement

8.1 An agreement between uniqbridles.com and a customer is concluded after an order has been assessed by uniqbridles.com for feasibility.

8.2 uniqbridles.com reserves the right, without giving reasons, not to accept orders or assignments or to accept them only under the condition that the shipment takes place cash on delivery or after payment in advance.

Pictures and Specifications

9.1 All Images; photos, drawings, etc.; including data on weights, dimensions, colors, images of labels, etc. on the uniqbridles.com internet site are only approximate, are indicative and cannot give rise to compensation or dissolution of the agreement.

Force majeure

10.1 uniqbridles.com is not liable if and insofar as its obligations cannot be fulfilled due to force majeure.

10.2 Force majeure is understood to mean any strange cause, and also any circumstance, which should not reasonably be at its risk. Delays in or non-performance by our suppliers, disruptions on the Internet, disruptions in electricity, disruptions in e-mail traffic and disruptions or changes in technology supplied by third parties, transport difficulties, strikes, government measures, delays in supply, negligence by suppliers and/or manufacturers of uniqbridles.com and also auxiliary persons, defects in aids or means of transport are expressly regarded as force majeure.

10.3 Uniqbridles.com reserves the right to suspend its obligations in the event of force majeure and is also entitled to dissolve the agreement in whole or in part, or to demand that the content of the agreement be changed in such a way that execution remains possible. Under no circumstances is uniqbridles.com obliged to pay any fine or compensation.

Liable

11.1 Uniqbridles.com is not liable for damage caused by incorrect use of the products. Before use, read the instructions on the packaging and/or consult our website.

Applicable law/competent court

12.1 Dutch law applies to all agreements.

12.2 Disputes arising from an agreement between uniqbridles.com and the buyer, which cannot be resolved in mutual consultation, will be heard by the competent court within the district of The Hague, unless uniqbridles.com prefers to transfer the difference to the competent court. of the place of residence of the buyer, and with the exception of those disputes that fall within the jurisdiction of the subdistrict court.
